By accessing or using the site, you are accepting these terms (on behalf of yourself or the entity that you represent), and you represent and warrant that you have the right, authority, and capacity to enter into these terms (on behalf of yourself or the entity that you represent). You may not access or use the site or accept the terms if you are not at least 18 years old. If you do not agree with all of the provisions of these terms, do not access and/or use the site.

Expedited Eviction Assistance reserves the right to update the terms at any time without notice to you, and you agree that Expedited Eviction Assistance may change the terms and conditions that govern your use of the Site and our services. Continued use of our Site following any change to the terms indicates your acknowledgement of such changes and agreement to be bound by modified terms and conditions.

1. FILE INFORMATION

1.1 FILE INFORMATION CREATION

In order to use and access certain features of the services from the Site, you agree that a File may be created for you and modified through interaction with Expedited Eviction Assistance via website form submissions, text messages, phone calls and emails. The information you submit to Expedited Eviction Assistance shall be the property of Expedited Eviction Assistance, and Expedited Eviction Assistance shall limit its use of such information to that which is reasonably necessary to accomplish the purpose of the Site Services. You represent and warrant that: (a) all required information you submit to Expedited Eviction Assistance is current, complete, truthful and accurate; and (b) you will maintain the accuracy of such information. Expedited Eviction Assistance may suspend or terminate your File in accordance with Section 10. Suspending or terminating your File will not lessen, reduce, or modify any amounts you may owe to us for services rendered or purchased.

1.2 FILE INFORMATION AND SECURITY RESPONSIBILITIES

You are responsible for maintaining the confidentiality and security of your File information and your interaction with Expedited Eviction Assistance. Expedited Eviction Assistance is not liable for any loss that you may incur as a result of someone else accessing or modifying your file information by impersonating you in emails, phone calls, texts or website submissions, either with or without your knowledge. You may not share your File information with anyone else. You agree to immediately notify us of any unauthorized use, or suspected unauthorized use of your File or any other breach of security. Expedited Eviction Assistance cannot and will not be liable for any loss or damage arising from your failure to comply with the above requirements.

2. ACCESS TO THE SITE

2.1 LICENSE

Subject to these Terms, Expedited Eviction Assistance grants you a non-transferable, non-exclusive, revocable, limited license to use and access the Site solely for your own personal, noncommercial use.

2.2 CERTAIN RESTRICTIONS

Unless otherwise indicated, any future release, update, or other addition to functionality of the Site shall be subject to these Terms.

2.3 MODIFICATION

Expedited Eviction Assistance reserves the right, at any time, to modify, suspend, or discontinue the Site (in whole or in part) with or without notice to you. You agree that Expedited Eviction Assistance will not be liable to you or to any third party for any modification, suspension, or discontinuation of the Site or any part thereof.

2.4 NO SUPPORT OR MAINTENANCE

You acknowledge and agree that Expedited Eviction Assistance will have no obligation to provide you with any support or maintenance in connection with the Site.

2.5 OWNERSHIP

You acknowledge that all the intellectual property rights, including copyrights, patents, trademarks, and trade secrets, in the Site and its content are owned by Expedited Eviction Assistance or its agents. Neither these Terms nor your access to the Site transfers to you or any third party any rights, title or interest in or to such intellectual property rights, except for the limited access rights expressly set forth in Section 2.1. There are no implied licenses granted under these Terms.

3. ARTIFICIAL INTELLIGENCE; ACCEPTABLE USE

3.1 Expedited Eviction Assistance USE OF AI, LIMITATION OF LIABILITY FOR USE OF AI RELATED PRODUCTS

Expedited Eviction Assistance uses technology provided by third-party service providers to provide services that use, in whole or in part, Artificial Intelligence (AI). You agree and acknowledge that Expedited Eviction Assistance use of AI technology, and your use of such AI technology to generate templates, text, documents, analysis, reports or other generated data is experimental, and you further agree to carefully review any and all AI generated data and documents of any kind for errors. Because you input the images, code, and/or text that results in AI generated data or documents, you understand and agree that you are solely responsible of the input and the generated output of the AI modules, products or programs that you access through the services purchased on this Site. You expressly agree that under no circumstances, regardless of any claim, legal theory or cause of action, shall Expedited Eviction Assistance’ liability exceed the amount you paid to Expedited Eviction Assistance for the use of its services through this Site.

3.2 ACCEPTABLE USE POLICY

The following terms constitute our “Acceptable Use Policy”:

• a. You agree not to use the Site – and any AI product or program accessible through the Site – to collect, upload, transmit, display, or distribute any User Content: (i) that violates any third-party right, including any copyright, trademark, patent, trade secret, moral right, privacy right, right of publicity, or any other intellectual property or proprietary right; (ii) that is unlawful, harassing, abusive, tortious, threatening, harmful, invasive of another’s privacy, vulgar, defamatory, false, misleading, trade libelous, pornographic, obscene, patently offensive, promotes racism, bigotry, hatred, or physical harm of any kind against any group or individual or is otherwise objectionable; (iii) that is harmful to minors in any way; or (iv) that is in violation of any law, regulation, or obligations or restrictions imposed by any third party.
• b. You agree not to: (i) upload, transmit, or distribute to or through the Site any computer viruses, worms, Trojan horses, time bombs, cancelbots, corrupted files, or any software intended to damage or alter a computer system or data; (ii) send through the Site unsolicited or unauthorized advertising, promotional materials, junk mail, spam, political campaigning, chain letters, pyramid schemes, or any other form of duplicative or unsolicited messages, whether commercial or otherwise; (iii) use the Site to harvest, collect, gather or assemble information or data regarding other users, including e-mail addresses, without their consent; (iv) interfere with, disrupt, or create an undue burden on servers or networks connected to the Site, or violate the regulations, policies or procedures of such networks; (v) attempt to gain unauthorized access to the Site (or to other computer systems or networks connected to or used together with the Site), whether through password mining or any other means; (vi) harass or interfere with any other user’s use and enjoyment of the Site; (vii) use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of User Content; or (viii) use software or automated agents or scripts to produce multiple files on the Site, or to generate automated searches, requests, or queries to (or to strip, scrape, or mine data from) the Site.

4. NO LEGAL ADVICE; YOUR USE OF Expedited Eviction Assistance PRODUCTS

4.1 Your use of the Site will also provide you with the opportunity to purchase products related to evictions and preparing and deploying defense strategies against evictions. Eviction defense services are commonly performed by laymen representing themselves and/or working in their own interest, as well as trained, licensed lawyers. EXPEDITED EVICTION ASSISTANCE IS A LEGAL COORDINATION SERVICE WITH EVICTION DEFENSE EXPERIENCE SINCE 2017, BUT IT IS NOT A LAW FIRM, AND NOTHING ON THE SITE SHOULD BE CONSTRUED AS LEGAL ADVICE. By using this site, and by purchasing any products or services on this site, you do so based on the express understanding that Expedited Eviction Assistance is not a law firm, and you are not purchasing legal services or receiving legal advice from Expedited Eviction Assistance.

5. THIRD-PARTY LINKS & ADS

The Site, whether now or in the future, may contain links to third-party websites and services, and/or display advertisements for third parties (collectively, “Third-Party Links & Ads”). Such Third-Party Links & Ads are not under the control of Expedited Eviction Assistance. Expedited Eviction Assistance is not responsible for any Third-Party Links & Ads. Expedited Eviction Assistance provides access to these Third-Party Links & Ads only as a convenience to you, and does not review, approve, monitor, endorse, warrant, or make any representations with respect to Third-Party Links & Ads. Expedited Eviction Assistance does not represent or warrant the accuracy or reliability of any advice, opinion, statement, or other information displayed or distributed through any Third-Party Links & Ads. You use all Third-Party Links & Ads at your own risk, and you should apply a suitable level of caution and discretion in doing so.

6. INDEMNIFICATION

You agree to indemnify and hold Expedited Eviction Assistance (and its officers, employees, and agents) harmless, including costs and attorneys’ fees, from any claim or demand made by any third party due to or arising out of (a) your use of the Site, (b) your generated AI data or documents, (c) your violation of these Terms; or (d) your violation of applicable laws or regulations. Expedited Eviction Assistance reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of these claims.

7. RELEASE

You hereby release and forever discharge Expedited Eviction Assistance (and our officers, employees, agents, successors, and assigns) from, and hereby waive and relinquish, each and every past, present, and future dispute, claim, controversy, demand, right, obligation, liability, action, and cause of action of every kind and nature (including personal injuries, death, and property damage), that has arisen or arises directly or indirectly out of, or that relates directly or indirectly to, the Site. YOU ACKNOWLEDGE THAT YOU ARE FAMILIAR WITH THE PROVISIONS OF SECTION 1542 OF THE CALIFORNIA CIVIL CODE, WHICH PROVIDES AS FOLLOWS: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY.” YOU HEREBY EXPRESSLY WAIVE AND RELINQUISH ALL RIGHTS AND BENEFITS UNDER SECTION 1542 OF THE CALIFORNIA CIVIL CODE AND ANY LAW OR LEGAL PRINCIPLE OF SIMILAR EFFECT IN ANY JURISDICTION WITH RESPECT TO THE RELEASES AND/OR DISCHARGES GRANTED HEREIN, INCLUDING BUT NOT LIMITED TO THE RELEASES AND/OR DISCHARGES OF UNKNOWN CLAIMS.

8. DISCLAIMERS

8.1 THE SITE, INCLUDING ALL CONTENT, SOFTWARE, PRODUCTS, SERVICES, MATERIALS, AND INFORMATION MADE AVAILABLE ON OR ACCESSED THROUGH THE SITE, IS PROVIDED ON AN “AS-IS” AND “AS AVAILABLE” BASIS, AND, TO THE MAXIMUM EXTENT PERMITTED BY LAW, Expedited Eviction Assistance AND ITS AGENTS EXPRESSLY DISCLAIM ANY AND ALL WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ALL WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, ACCURACY, OR NON-INFRINGEMENT.

9. LIMITATION ON LIABILITY

9.1 THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL Expedited Eviction Assistance OR OUR SUPPLIERS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY LOST PROFITS, LOST DATA, COSTS OF PROCUREMENT OF SUBSTITUTE PRODUCTS, OR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SITE, INCLUDING ANY CONTENT, SOFTWARE, PRODUCTS, SERVICES, MATERIALS, AND INFORMATION INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE SITE, EVEN IF Expedited Eviction Assistance HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

10. TERM AND TERMINATION

Subject to this Section, these Terms will remain in full force and effect while you use the Site. We may refuse service, remove or edit content, or suspend or terminate your rights to use the Site (including your File information) at any time for any reason at our sole discretion, including for any use of the Site in violation of these Terms. Upon termination of your rights under these Terms, your access to File information and right to access and use the Site will terminate immediately. You understand that any termination of your File may involve deletion of your File information and user generated data associated with your File from our databases.

11. ENFORCEMENT

We reserve the right (but have no obligation) to review any User generated data or documents, and to investigate any violation of these Terms, and/or take appropriate remedial action against you in our sole discretion if you violate the Acceptable Use Policy or any other provision of these Terms or otherwise create liability for us or any other person.

12. THE MONEY BACK GUARANTEE; CREDIT CARD CHARGEBACKS

12.1 THE MONEY BACK GUARANTEE

From time to time, Expedited Eviction Assistance may offer a Money Back Guarantee for service(s) or product(s) offered for sale on the Site. In the event a Money Back Guarantee is offered, please note the following terms, all of which are considered material terms:

• A. To obtain a refund, you must strictly comply with all the applicable steps, tasks, timeframes for compliance, and deadlines as set forth in the instructions. Failure to strictly comply will disqualify you from receiving a refund. If any deferment, forbearance, or delay is obtained through the service, the intended purpose is achieved.
• B. The customer is solely responsible for providing accurate, complete, and truthful information related to their eviction matter.
• C. The legal services provided are limited to advice, documentation, and further consultation if required. We do not offer court representation.
• D. The customer acknowledges that court decisions are outside the control of Expedited Eviction Assistance.
• E. The customer is responsible for filing the provided legal documents with the court or any relevant authorities.
• F. While Expedited Eviction Assistance will provide legal documentation, the customer is ultimately responsible for presenting their case.
• G. Refund claims cannot be made based on the court’s ruling or outcome.
• H. The customer acknowledges that the eviction process can only be dismissed or stopped when they pay the overdue rent amount.
• I. Expedited Eviction Assistance is not responsible for any consequences arising from the tenant’s failure to pay rent on time.
• J. & K. We may require proof demonstrating strict compliance with all instructions and proof demonstrating failure to achieve a reasonable successful result.
• L. Refund is limited to one per lifetime for each user or purchaser, and their household.
• M. Purchasers providing false information (incorrect notices, misleading rental agreement status, false identities) shall be ineligible for a refund.
• N. The Money Back Guarantee does not apply if you use different contact info, fail to submit complete documents, or purchase the service after your deadline has passed.
• O. The guarantee is NOT applicable to discounted products or installment payment plans.

12.2 PAYMENT PLANS

Expedited Eviction Assistance currently offers the following payment options:

• Full purchase price payment.
• Acceptance of a purchaser’s offer at a discount.
• Payment plan with a total of 2-4 payments over 2 weeks to 4 months.
• Customized invoice allowing for minimum payments of no less than $119.00.

13. FEEDBACK

If you provide feedback regarding the Site, you assign to Expedited Eviction Assistance all rights in such Feedback and agree that we shall have the right to use and fully exploit such information in any manner deemed appropriate without attribution or compensation.

14. GENERAL

14.1 Governing Law: Matters relating to the Site will be governed by the laws of the United States and the State of Arizona. Any dispute arising shall be resolved in a court of competent jurisdiction in Maricopa County Arizona.

14.2 Export: The Site may be subject to U.S. export control laws. You agree not to export technical data acquired from Expedited Eviction Assistance in violation of these laws.

14.3 Electronic Communications: You consent to receive communications from Expedited Eviction Assistance in an electronic form. These satisfy any legal requirement that such communications would satisfy if it were in a hardcopy writing.

14.4 Entire Terms: These Terms constitute the entire agreement regarding the use of the Site. Our failure to exercise any right shall not operate as a waiver.
